Today Donald Trump made history as the first president to attend arguments before the Supreme Court. The case is whether the administration’s executive order ending birthright citizenship is constitutional. The fourteenth amendment ratified in 1868 says “All persons BORN or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States….” It’s very clear and the idea that it applies to all people irrespective of whether their parents are citizens or not has been the law of the land since an 1898 ruling affirming just that.
Trump watched his solicitor general try to argue that the courts got it wrong 120 years ago. The justices seemed skeptical with even chief justice Roberts saying “it’s a new world (but) it’s the same constitution.”
We cannot yet know the decision which is expected in June or July but we can hope that the third article of the Constitution may yet stand. The court appears at least to be reluctant to allow this mind boggling attempt to rewrite our founding document through fiat to stand.
